Terms and Conditions
1. GENERAL
1.1 Scope of application
The following general terms and conditions (“Terms”) apply when you, as a consumer/customer (“You”), make a purchase via PlakatKunst.com (“the Website”). Agreements are entered into between You and PlakatKunst.com / Daugberg Design, company registration no. 40688331 (“PlakatKunst.com”). Contact details and further information about PlakatKunst.com are available on the Website. The Terms apply exclusively to consumers purchasing via the Website.
1.2 Age requirement
To place an order on the Website, You must be at least 18 years old. In accordance with Danish law, PlakatKunst.com does not accept purchases made by persons under the age of 18. PlakatKunst.com reserves the right, in individual cases, to reject or amend an order, for example if incorrect personal information has been provided, if there is repeated and unjustified use of the right of withdrawal, or if there are records of payment default.
1.3 Reservations
PlakatKunst.com reserves the right for sold-out products and any image or typographical errors on the Website, including incomplete product descriptions, technical specifications, or incorrect stock information. PlakatKunst.com reserves the right to correct such errors and to continuously amend or update the information on the Website. If an incorrect price is stated for a product You have ordered, PlakatKunst.com will notify You by email and await your acceptance of the corrected price before the order is completed.
1.4 Intellectual property rights
The Website and all content on it are owned by PlakatKunst.com and are protected by intellectual property and marketing law. This includes, among other things, product names, images, design, and text. The content may not be copied, used, or distributed without prior written consent from PlakatKunst.com.
2. AGREEMENT AND ORDERING
2.1 Conclusion of agreement
To make a purchase via the Website, You must accept the Terms. By accepting them, You undertake to comply with these Terms and confirm that You have familiarized yourself with PlakatKunst.com’s processing of personal data in accordance with the company’s Privacy Policy.
2.2 Order confirmation and cancellation
A binding purchase agreement is only concluded once PlakatKunst.com has confirmed your order and You have received an order confirmation from orders@plakatkunst.com by email. You may cancel your order within 24 hours by contacting info@plakatkunst.com. In the event of cancellation, the reserved payment made in connection with the order will be released.
3. CUSTOMER INFORMATION
3.1 Accuracy of information
When creating a user account and/or completing a purchase, You will be asked to provide personal information. You confirm that the information You provide is accurate and complete, and You are responsible for any incorrect information.
3.2 Access and responsibility
You are responsible for protecting your login details and must not disclose your username or password to third parties. PlakatKunst.com must be notified immediately if You suspect that your information has been misused. You are responsible for all purchases made using your login details until PlakatKunst.com has been informed of any misuse.
3.3 Misuse
If PlakatKunst.com suspects misuse of a user account or a breach of the Terms, PlakatKunst.com reserves the right to block the account or issue new login credentials.
4. PRICES, PAYMENT AND FEES
4.1 Prices
All prices on the Website are stated in Danish kroner (DKK) and include VAT, unless otherwise clearly stated.
4.2 Payment methods
Payment can be made using the payment methods listed on the Website via an encrypted connection through Shopify Payments. PlakatKunst.com reserves the right not to offer all payment methods at all times.
4.3 Time of payment
Payment is generally charged when the order is dispatched. As all picture frames are made to order, more than 7 days may in some cases pass between order placement and dispatch. In such cases, payment may be charged when production is initiated and no later than 7 days after the order is placed, in accordance with applicable card and payment regulations. The order is dispatched as soon as it has been fully produced and is ready for delivery.
5. DELIVERY AND TRANSPORT
5.1 Delivery time
Orders are generally dispatched from our Danish framing workshop within 4 business days and almost always within 7 business days. The time it takes for GLS or FedEx to deliver your parcel primarily depends on your location and, secondly, on factors beyond our control, such as weather conditions and other challenges that may arise during transport.
All picture frames are produced to order at our workshop. The stated delivery time is therefore indicative only, unless otherwise expressly agreed.
Unless otherwise agreed, delivery will take place no later than 25 days after the order confirmation. If this deadline is exceeded for reasons not attributable to You as the customer, You are entitled to cancel the purchase.
5.2 Receipt and collection
If the parcel is delivered to a parcel shop, it must be collected within the time limit specified in the carrier’s notification.
For home delivery, it is the customer’s responsibility to ensure that delivery can take place. Smaller parcels may alternatively be redirected to a parcel shop. Larger deliveries may, by agreement, be left at the delivery address.
If a parcel is returned to PlakatKunst.com because it is not collected from the parcel shop, PlakatKunst.com is entitled to deduct the actual shipping and handling costs when refunding the order.
5.3 Delivery outside the EU
For orders shipped outside the EU, PlakatKunst.com does not charge VAT (25%).
For deliveries to countries outside the EU, the shipment may be subject to local customs clearance, including customs duties, VAT and other charges imposed by the authorities in the destination country. Any such charges are payable by the buyer.
The local customs authorities or the carrier will normally contact the buyer directly once the shipment arrives in the destination country in order to arrange customs clearance and payment of any applicable charges prior to delivery.
6. RIGHT OF WITHDRAWAL
6.1 Withdrawal period
For purchases made via the Website, You have a 100-day right of withdrawal. The withdrawal period runs from the day You receive the product.
6.2 Notice of withdrawal
If You wish to withdraw from your purchase, You must notify PlakatKunst.com clearly within the withdrawal period by email to info@plakatkunst.com, as described here.
6.3 Return of goods
The product must be returned no later than 14 days after You have notified us of your withdrawal. The product must be securely packaged, in the same condition as when received, and in its original packaging.
6.4 Exceptions to the right of withdrawal
The right of withdrawal does not apply to products made according to the customer’s specifications or with a clearly personalized character. This includes, among other things, products in custom sizes, including made-to-measure frames, custom-cut mounts, and box frames in special dimensions.
6.5 Refund and deduction of shipping costs
In the event of withdrawal, PlakatKunst.com will refund the price of the product. Delivery costs are not refunded.
PlakatKunst.com is entitled to deduct the shipping costs for delivery to the customer as well as the shipping costs for return to PlakatKunst.com. These shipping costs may exceed the amount originally paid by the customer for delivery.
Any reduction in value resulting from handling beyond what is necessary to establish the nature and characteristics of the product may be deducted from the refund.
6.6 Refund payment
The refund will be made without undue delay and no later than 14 days after PlakatKunst.com has received the returned product.
7. WARRANTY AND COMPLAINTS
7.1 Product description
PlakatKunst.com delivers products in accordance with the applicable product description. Minor visual deviations may occur, including color variations, as digital representations are not always completely accurate. The order confirmation serves as documentation for the purchase.
7.2 Right to complain
The right to complain covers defects and non-conformities in accordance with applicable consumer protection legislation. You have a 24-month right to complain, and complaints must be made within a reasonable time after the defect is discovered. Complaints made within 14 days of discovery are always considered timely.
7.3 Transport damage
In the event of visible transport damage – including damaged packaging, broken or cracked glass, or if it can be heard that the contents are damaged – it is recommended that the shipment be inspected upon receipt at the parcel shop or from the carrier. In the case of obvious damage, it is recommended to refuse receipt or note the damage upon delivery. Transport damage must be reported to PlakatKunst.com as soon as possible and no later than 7 days after receipt.
7.4 Return shipping for complaints
PlakatKunst.com covers the return shipping costs for approved complaints, provided that PlakatKunst.com issues a return label.
8. FORCE MAJEURE
PlakatKunst.com is not liable for delays resulting from circumstances beyond the company’s control, including war, labor disputes, extreme weather conditions, fire, acts of terrorism, or governmental intervention. If such circumstances persist for more than two months, either party may terminate the agreement.
9. CHANGES TO THE TERMS
PlakatKunst.com reserves the right to amend the Terms. Changes will be published on the Website and will take effect upon acceptance in connection with a new purchase or, at the latest, 30 days after publication.
10. INVALIDITY
If any provision of these Terms is declared invalid, this shall not affect the validity of the remaining provisions.
11. GOVERNING LAW AND DISPUTES
11.1 Amicable resolution
Disputes shall initially be sought resolved amicably between the parties through dialogue with PlakatKunst.com’s customer service.
11.2 Governing law and venue
Any dispute relating to the interpretation or application of these Terms shall be governed by Danish law and decided by the ordinary Danish courts.
11.3 EU ODR platform
If a dispute cannot be resolved amicably, You may, as a consumer, submit a complaint via the European Commission’s Online Dispute Resolution (ODR) platform, available at http://ec.europa.eu/consumers/odr.
